Terms and Conditions. The terms and conditions governing the use of CosmicStock Photography mobile sites are set forth below. By clicking on the order button on the sales page, you are agreeing to bound by the terms and conditions set forth in this agreement. This agreement applies to all CosmicStock Photography products/services that you purchase.
Services. CosmicStock Photography will complete services within 7-14 days from the purchase date.
Client Responsibilities. The Client agrees to cooperate with CosmicStock Photography in the performance of the services under the agreement and shall provide or arrange to provide CosmicStock Photography with timely access to and use of the personnel, facilities, equipment, data and information to the extent necessary for CosmicStock Photography to perform the services under the Agreement.
The Client shall be responsible for the accuracy and completeness of all data and information provided to CosmicStock Photography.
The Client will communicate with CosmicStock Photography in a professional manner.

Termination. Unless terminated sooner in accordance with these terms, the work shall terminate on the completion of CosmicStock Photography services hereunder. Completion shall be evidenced by the delivery and final approval by the client, at which time the mobile site will be live.
Email Communication. The Client recognizes and accepts the risks associated with communicating by Internet e-mail, including (but without limitation) issues of security, unreliability of delivery and possible loss of confidentiality. The Client assumes all responsibility or liability in respect of risk associated with its use.
Force Majeure. Neither the Client nor CosmicStock Photography shall be liable for any delays resulting from circumstances or causes beyond its reasonable control, including, without limitation, fire or other casualty, act of God, strike or labor dispute, war or other violence, or any law, order or requirement of any governmental agency or authority.
Fee(s). Client shall pay the fee shown on the sales page of this website for the usage rights granted.
Payment. Payment is due in full upon placing the order by credit card or PayPal. Orders will not be processed until full payment has been received.
Indemnification. Client agrees to indemnify and hold harmless CosmicStock Photography against any and all claims, costs, and expenses, including attorney's fees, arising from loss of usage if and when there is a server outage.
Arbitration. All disputes shall be submitted to binding arbitration before Douglas Christie, Barrister and Solicitor, in the city of Victoria, in the province of British Columbia, Canada, and settled in accordance with the rules of Natural Justice and in compliance with the Laws of British Columbia. Judgment upon the arbitration award may be entered in any court having jurisdiction thereof. Disputes in which the amount at issue is less than $500.00 shall not be subject to this arbitration provision. The arbitration shall be at the cost of the client unless the arbitrator otherwise orders in his sole discretion.
Assignment. This license is not transferable to a third party. Further, the use of the software is restricted to the usage set out in this licensing agreement, unless other provisions have been made with CosmicStock Photography. You may not transfer or assign any rights or obligations hereunder without the consent of the other party, except that CosmicStock Photography shall have the right to assign monies due.
Miscellany. This Agreement shall be binding upon the parties hereto, their heirs, successors, assigns, and personal representatives. This Agreement constitutes the full understanding between the parties hereto. Its terms may only be modified by a written instrument signed by both parties. A waiver of a breach of any of the provisions of this Agreement shall not be construed as a continuing waiver of other breaches of the same or other provisions hereof. This Agreement shall be governed by the laws of the Province of British Columbia, Canada.
